  IhavethehonortotransmitherewithanaddresstothePresidentoftheUnitedStates,andthroughhimtobothHousesofCongress,ontheconditionandwantsofthepeopleofeastTennessee,andaskingtheirattentiontothenecessityofsomeactiononthepartoftheGovernmentfortheirrelief,andwhichaddressispresentedbyacommitteeofanorganizationcalled\"TheEastTennesseeReliefAssociation。\"

  Deeplycommiseratingtheconditionofthesemostloyalandsufferingpeople,Iamunpreparedtomakeanyspecificrecommendationfortheirrelief。Themilitaryisdoingandwillcontinuetodothebestforthemwithinitspower。TheiraddressrepresentsthattheconstructionofdirectrailroadcommunicationbetweenKnoxvilleandCincinnatibywayofcentralKentuckywouldbeofgreatconsequenceinthepresentemergency。ItmayberememberedthatintheannualmessageofDecember,1861,suchrailroadconstructionwasrecommended。Inowaddthat,withtheheartyconcurrenceofCongress,Iwouldyetbepleasedtoconstructaroad,bothforthereliefofthesepeopleandforitscontinuingmilitaryimportance。

  Inobediencetotheresolutionofyourhonorablebody,acopyofwhichisherewithreturned,Ihavethehonortomakethefollowingbriefstatement,whichisbelievedtocontaintheinformationsought:

  PriortoandatthemeetingofthepresentCongress,RobertC。

  Schenck,ofOhio,andFrankP。Blair,Jr。,ofMissouri,memberselectthereto,byandwiththeconsentoftheSenateheldcommissionsfromtheExecutiveasmajor—generalsinthevolunteerarmy。GeneralSchencktenderedtheresignationofhissaidcommission,andtookhisseatintheHouseofRepresentatives,attheassemblingthereof,uponthedistinctverbalunderstandingwiththeSecretaryofWarandtheExecutivethathemight,atanytimeduringthesession,athisownpleasure,withdrawsaidresignationandreturntothefield。

  GeneralBlairwas,bytemporaryassignmentofGeneralSherman,incommandofacorpsthroughthebattlesinfrontofChattanooga,andinthemarchtothereliefofKnoxville,whichoccurredinthelatterdaysofNovemberandearlydaysofDecemberlast,andofcoursewasnotpresentattheassemblingofCongress。Whenhesubsequentlyarrivedhere,hesought,andwasallowedbytheSecretaryofWarandtheExecutive,thesameconditionsandpromiseasallowedandmadetoGeneralSchenck。

  GeneralSchenckhasnotappliedtowithdrawhisresignation;butwhenGeneralGrantwasmadeLieutenant—General,producingsomechangeofcommanders,GeneralBlairsoughttobeassignedtothecommandofacorps。ThiswasmadeknowntoGeneralsGrantandSherman,andassentedtobythem,andtheparticularcorpsforhimdesignated。

  Thiswasallarrangedandunderstood,asnowremembered,somuchasamonthago;buttheformalwithdrawalofGeneralBlair’sresignation,andmakingtheorderassigninghimtothecommandofthecorps,werenotconsummatedattheWarDepartmentuntillastweek,perhapsonthe23dofAprilinstant。Asasummaryofthewhole,itmaybestatedthatGeneralBlairholdsnomilitarycommissionorappointmentotherthanashereinstated,andthatitisbelievedheisnowactingasmajor—Generalupontheassumedvalidityofthecommissionhereinstated,inconnectionwiththefactshereinstated,andnototherwise。Therearesomeletters,notes,telegrams,orders,entries,andperhapsotherdocumentsinconnectionwiththissubject,whichitisbelievedwouldthrownoadditionallightuponit,butwhichwillbecheerfullyfurnishedifdesired。

  IamagainpressedwiththeclaimofMr。MarshallO。Roberts,fortransportationofwhatwascalledtheNavalBrigadefromNewYorktoFortressMonroe。ThisforcewasaspecialorganizationgotupbyoneBartlett,inpretendedpursuanceofwrittenauthorityfromme,butinfact,pursuingtheauthorityinscarcelyanythingwhatever。ThecreditgivenhimbyMr。Roberts,wasgivenintheteethoftheexpressdeclarationthattheGovernmentwouldnotberesponsiblefortheclassofexpensestowhichitbelonged。AfterallsomepartofthetransportationbecameusefultotheGovernment,andequitablyshouldbepaidfor;butIhaveneithertimenormeanstoascertainthisequitableamount,oranyappropriationtopayitwithifascertained。IftheQuartermasteratNewYorkcanascertainwhatwouldcompensateforsomuchofthetransportationasdidresultusefullytotheGovernment,itmightbeasteptowardsreachingjustice。Iwritethisfrommemory,butIbelieveitissubstantiallycorrect。

  AProclamation。

  Whereas,byaproclamationwhichwasissuedonthe15thdayofApril,1861,thePresidentoftheUnitedStatesannouncedanddeclaredthatthelawsoftheUnitedStateshadbeenforsometimepast,andthenwere,opposedandtheexecutionthereofobstructedincertainStatesthereinmentioned,bycombinationstoopowerfultobesuppressedbytheordinarycourseofjudicialproceedingsorbythepowervestedinthemarshalsbylaw;andWhereas,immediatelyaftertheissuingofthesaidproclamationthelandandnavalforcesoftheUnitedStateswereputintoactivitytosuppressthesaidinsurrectionsandrebellion;andWhereas,theCongressoftheUnitedStates,byanactapprovedonthethirddayofMarch,1863,didenactthatduringthesaidrebellionthePresidentoftheUnitedStates,wheneverinhisjudgmentthepublicsafetymayrequireit,isauthorizedtosuspendtheprivilegeofthewritofhabeascorpusinanycasethroughouttheUnitedStates,oranypartthereof;andWhereas,thesaidinsurrectionandrebellionstillcontinue,endangeringtheexistenceoftheConstitutionandGovernmentoftheUnitedStates;andWhereas,themilitaryforcesoftheUnitedStatesarenowactivelyengagedinsuppressingthesaidinsurrectionandrebellioninvariouspartsoftheStateswherethesaidrebellionhasbeensuccessfulinobstructingthelawsandpublicauthorities,especiallyintheStatesofVirginiaandGeorgia;andWhereas,onthefifteenthdayofSeptemberlast,thePresidentoftheUnitedStatesdulyissuedhisproclamation,whereinhedeclaredthattheprivilegeofthewritofhabeascorpusshouldbesuspendedthroughouttheUnitedStates,inCaseswherebytheauthorityofthePresidentoftheUnitedStates,themilitary,naval,andcivilofficersoftheUnitedStates,oranyofthem,holdpersonsundertheircommandorintheircustody,eitherasprisonersofwar,spies,oraidersorabettorsoftheenemy,orofficers,soldiers,orseamenenrolledordrafted,ormustered,orenlistedin,orbelongingtothelandornavalforcesoftheUnitedStates,orasdeserterstherefrom,orotherwiseamenabletomilitarylaw,ortherulesandarticlesofwar,ortherulesandregulationsprescribedforthemilitaryandnavalservicebyauthorityofthePresidentoftheUnitedStates,orforresistingadraft,orforanyotheroffenceagainstthemilitaryornavalservice;andWhereas,manycitizensoftheStateofKentuckyhavejoinedtheforcesoftheinsurgents,whohaveonseveraloccasionsenteredthesaidStateofKentuckyinlargeforceandnotwithoutaidandcomfortfurnishedbydisaffectedanddisloyalcitizensoftheUnitedStatesresidingtherein,havenotonlygreatlydisturbedthepublicpeacebuthaveoverbornethecivilauthoritiesandmadeflagrantcivilwar,destroyingpropertyandlifeinvariouspartsoftheState;andWhereas,ithasbeenmadeknowntothePresidentoftheUnitedStates,bytheofficerscommandingtheNationalarmies,thatcombinationshavebeenformedinthesaidStateofKentucky,withapurposeofincitingtherebelforcestorenewthesaidoperationsofcivilwarwithinthesaidState,andtherebytoembarrasstheUnitedStatesarmiesnowoperatinginthesaidStatesofVirginiaandGeorgia,andeventoendangertheirsafety。

  Now,therefore,I,AbrahamLincoln,PresidentoftheUnitedStates,byvirtueoftheauthorityvestedinmebytheConstitutionandlaws,doherebydeclarethatinmyjudgmentthepublicsafetyespeciallyrequiresthatthesuspensionoftheprivilegeofthewritofhabeascorpussoproclaimedinthesaidproclamationofthe15thofSeptember,1863,bemadeeffectualandbedulyenforcedinandthroughoutthesaidStateofKentucky,andthatmartiallawbeforthepresentdeclaredtherein。IdothereforeherebyrequireofthemilitaryofficersofthesaidStatethattheprivilegeofthehabeascorpusbeeffectuallysuspendedwithinthesaidState,accordingtotheaforesaidproclamation,andthatmartiallawbeestablishedthereintotakeeffectfromthedateofthisproclamation,thesaidsuspensionandestablishmentofmartiallawtocontinueuntilthisproclamationshallberevokedormodified,butnotbeyondtheperiodwhenthesaidrebellionshallhavebeensuppressedorcometoanend。

  AndIdoherebyrequireandcommand,aswellasmilitaryofficers,allcivilofficersandauthoritiesexistingorfoundwithinthesaidStateofKentucky,totakenoticeofthisproclamationandtogivefulleffecttothesame。Themartiallawshereinproclaimedandthethingsinthatrespecthereinorderedwillnotbedeemedortakentointerferewiththeholdingoflawfulelections,orwiththeproceedingsoftheconstitutionalLegislatureofKentucky,orwiththeadministrationofjusticeinthecourtsoflawexistingthereinbetweencitizensoftheUnitedStatesinsuitsorproceedingswhichdonotaffectthemilitaryoperationsortheconstitutedauthoritiesofthegovernmentoftheUnitedStates。
