2ThefineisbasedontheoldEuropeanideathateverybodypossessesprivatepropertyinsomereasonabledegree；butnotonlyisthisnottrueto-day，butitisnotbeingmadeanytruer，evenbythosewhohonestlybelievethattheyaremendingmatters。Thegreatemployerswilloftendosomethingtowardsimprovingwhattheycallthe\"conditions\"oftheirworkers；butaworkermighthavehisconditionsascarefullyarrangedasaracehorsehas，andstillhavenomorepersonalpropertythanaracehorse。

Anold-fashionedshopkeepermighthavelockeduphisapprenticeinhiscoal-cellar；buthiscoal-cellarwouldbeareal，pitchdarkcoal-cellar，andtherestofhishousewouldbearealhumanhouse。Everybodyespeciallytheapprenticewouldseeamostperceptibledifferencebetweenthetwo。But，asIpointedoutinthearticlebeforethis，thewholetendencyofthecapitalistlegislationandexperimentistomakeimprisonmentmuchmoregeneralandautomatic，whilemakingit，orprofessingtomakeit，morehumane。Inotherwords，thehygienicprisonandtheservilefactorywillbecomesouncommonlylikeeachotherthatthepoormanwillhardlyknoworcarewhetherheisatthemomentexpiatinganoffenceormerelyswellingadividend。Inbothplacestherewillbethesamesortofshinytiles。Inneitherplacewilltherebeanycellsounwholesomeasacoal-cellarorsowholesomeasahome。Theweaponoftheprison，therefore，liketheweaponofthefine，willbefoundtohaveconsiderablelimitationstoitseffectivenesswhenemployedagainstthewretchedreducedcitizenofourday。Whetheritbepropertyorlibertyyoucannottakefromhimwhathehasnotgot。Youcannotimprisonaslave，becauseyoucannotenslaveaslave。
