GENTLEMEN:——AftertheadjournmentofCongressnowverynear,Ishallhavenoopportunityofseeingyouforseveralmonths。BelievingthatyouoftheborderStatesholdmorepowerforgoodthananyotherequalnumberofmembers,IfeelitadutywhichIcannotjustifiablywaivetomakethisappealtoyou。IintendnoreproachorcomplaintwhenIassureyouthat,inmyopinion,ifyouallhadvotedfortheresolutioninthegradual—emancipationmessageoflastMarch,thewarwouldnowbesubstantiallyended。Andtheplanthereinproposedisyetoneofthemostpotentandswiftmeansofendingit。LettheStateswhichareinrebellionseedefinitelyandcertainlythatinnoeventwilltheStatesyourepresenteverjointheirproposedconfederacy,andtheycannotmuchlongermaintainthecontest。ButyoucannotdivestthemoftheirhopetoultimatelyhaveyouwiththemsolongasyoushowadeterminationtoperpetuatetheinstitutionwithinyourownStates。Beatthematelections,asyouhaveoverwhelminglydone,and,nothingdaunted,theystillclaimyouastheirown。YouandIknowwhattheleveroftheirpoweris。Breakthatleverbeforetheirfaces,andtheycanshakeyounomoreforever。MostofyouhavetreatedmewithkindnessandconsiderationandItrustyouwillnotnowthinkIimproperlytouchwhatisexclusivelyyourown,when,forthesakeofthewholecountry,Iask,Canyou,foryourStates,dobetterthantotakethecourseIurge?
Discardingpunctilioandmaximsadaptedtomoremanageabletimes,andlookingonlytotheunprecedentedlysternfactsofourcase,canyoudobetterinanypossibleevent?YoupreferthattheconstitutionalrelationoftheStatestothenationshallbepracticallyrestoredwithoutdisturbanceoftheinstitution;andifthisweredone,mywholedutyinthisrespect,undertheConstitutionandmyoathofoffice,wouldbeperformed。Butitisnotdone,andwearetryingtoaccomplishitbywar。Theincidentsofthewarcannotbeavoided。
Ifthewarcontinueslong,asitmustiftheobjectbenotsoonerattained,theinstitutioninyourStateswillbeextinguishedbymerefrictionandabrasion——bythemereincidentsofthewar。Itwillbegone,andyouwillhavenothingvaluableinlieuofit。Muchofitsvalueisgonealready。Howmuchbetterforyouandforyourpeopletotakethestepwhichatonceshortensthewarandsecuressubstantialcompensationforthatwhichissuretobewhollylostinanyotherevent!Howmuchbettertothussavethemoneywhichelsewesinkforeverinwar!Howmuchbettertodoitwhilewecan,lestthewarerelongrenderuspecuniarilyunabletodoit!Howmuchbetterforyouasseller,andthenationasbuyer,toselloutandbuyoutthatwithoutwhichthewarcouldneverhavebeen,thantosinkboththethingtobesoldandthepriceofitincuttingoneanother’sthroats!Idonotspeakofemancipationatonce,butofadecisionatoncetoemancipategradually。RoominSouthAmericaforcolonizationcanbeobtainedcheaplyandinabundance,andwhennumbersshallbelargeenoughtobecompanyandencouragementforoneanother,thefreedpeoplewillnotbesoreluctanttogo。
Iampressedwithadifficultynotyetmentioned——onewhichthreatensdivisionamongthosewho,united,arenonetoostrong。Aninstanceofitisknowntoyou。GeneralHunterisanhonestman。Hewas,andIhopestillis,myfriend。Ivaluedhimnonethelessforhisagreeingwithmeinthegeneralwishthatallmeneverywherecouldbefree。HeproclaimedallmenfreewithincertainStates,andI
repudiatedtheproclamation。HeexpectedmoregoodandlessharmfromthemeasurethanIcouldbelievewouldfollow。Yet,inrepudiatingit,Igavedissatisfaction,ifnotoffence,tomanywhosesupportthecountrycannotaffordtolose。Andthisisnottheendofit。Thepressureinthisdirectionisstilluponme,andisincreasing。ByconcedingwhatInowaskyoucanrelieveme,and,muchmore,canrelievethecountryinthisimportantpoint。

Consideringthebillfor\"Anacttosuppressinsurrection,topunishtreasonandrebellion,toseizeandconfiscatethepropertyofrebels,andforotherpurposes,\"andthejointresolutionexplanatoryofsaidactasbeingsubstantiallyone,Ihaveapprovedandsignedboth。
BeforeIwasinformedofthepassageoftheresolutionIhadpreparedthedraftofamessagestatingobjectionstothebillbecomingalaw,acopyofwhichdraftisherewithtransmitted。

Iherewithreturntoyourhonorablebody,inwhichitoriginated,thebillforanactentitled\"Anacttosuppresstreasonandrebellion,toseizeandconfiscatethepropertyofrebels,andforotherpurposes,\"togetherwithmyobjectionstoitsbecomingalaw。
ThereismuchinthebilltowhichIperceivenoobjection。Itiswhollyprospective,andtouchesneitherpersonnorpropertyofanyloyalcitizen,inwhichparticularsitisjustandproper。ThefirstandsecondsectionsprovidefortheconvictionandpunishmentofpersonsWhoshallbeguiltyoftreasonandpersonswhoshall\"incite,setonfoot,assist,orengageinanyrebellionorinsurrectionagainsttheauthorityoftheUnitedStatesorthelawsthereof,orshallgiveaidandcomfortthereto,orshallengageinorgiveaidandcomforttoanysuchexistingrebellionorinsurrection。\"Byfairconstructionpersonswithinthesesectionsarenottobepunishedwithoutregulartrialsindulyconstitutedcourts,undertheformsandallthesubstantialprovisionsoflawandoftheConstitutionapplicabletotheirseveralcases。TothisIperceivenoobjection,especiallyassuchpersonswouldbewithinthegeneralpardoningpowerandalsothespecialprovisionforpardonandamnestycontainedinthisact。
Itisalsoprovidedthattheslavesofpersonsconvictedunderthesesectionsshallbefree。Ithinkthereisanunfortunateformofexpressionratherthanasubstantialobjectioninthis。ItisstartlingtosaythatCongresscanfreeaslavewithinaState,andyetifitweresaidtheownershipoftheslavehadfirstbeentransferredtothenationandthatCongresshadthenliberatedhimthedifficultywouldatoncevanish。Andthisistherealcase。ThetraitoragainsttheGeneralGovernmentforfeitshisslaveatleastasjustlyashedoesanyotherproperty,andheforfeitsbothtothegovernmentagainstwhichbeoffends。Thegovernment,sofarastherecanbeownership,thusownstheforfeitedslaves,andthequestionforCongressinregardtothemis,\"Shalltheybemadefreeorbesoldtonewmasters?\"IperceivenoobjectiontoCongressdecidinginadvancethattheyshallbefree。TothehighhonorofKentucky,asIaminformed,sheistheownerofsomeslavesbyescheat,andhassoldnone,butliberatedall。IhopethesameistrueofsomeotherStates。Indeed,IdonotbelieveitwillbephysicallypossiblefortheGeneralGovernmenttoreturnpersonssocircumstancedtoactualslavery。Ibelievetherewouldbephysicalresistancetoitwhichcouldneitherbeturnedasidebyargumentnordrivenawaybyforce。
InthisviewIhavenoobjectiontothisfeatureofthebill。
Anothermatterinvolvedinthesetwosections,andrunningthroughotherpartsoftheact,willbenoticedhereafter。
Iperceivenoobjectiontothethirdorfourthsections。
SofarasIwishtonoticethefifthandsixthsections,theymaybeconsideredtogether。Thattheenforcementofthesesectionswoulddonoinjusticetothepersonsembracedwithinthem,isclear。Thatthosewhomakeacauselesswarshouldbecompelledtopaythecostofit,istooobviouslyjusttobecalledinquestion。Togivegovernmentalprotectiontothepropertyofpersonswhohaveabandonedit,andgoneonacrusadetooverthrowthesamegovernment,isabsurd,ifconsideredinthemerelightofjustice。Theseverestjusticemaynotalwaysbethebestpolicy。Theprincipleofseizingandappropriatingthepropertyofthepersonsembracedwithinthesesectionsiscertainlynotveryobjectionable,butajustlydiscriminatingapplicationofitwouldbeverydifficultand,toagreatextent,impossible。Andwoulditnotbewisetoplaceapowerofremissionsomewhere,sothatthesepersonsmayknowtheyhavesomethingtolosebypersistingandsomethingtogainbydesisting?

Iamnotsurewhethersuchpowerofremissionisorisnotinsectionthirteen。WithoutanyspecialactofCongress,Ithinkourmilitarycommanders,when——inmilitaryphrase,\"theyarewithintheenemy’scountry,\"should,inanorderlymanner,seizeandusewhateverofrealorpersonalpropertymaybenecessaryorconvenientfortheircommands;atthesametimepreserving,insomeway,theevidenceofwhattheydo。
WhatIhavesaidinregardtoslaves,whilecommentingonthefirstandsecondsections,isapplicabletotheninth,withthedifferencethatnoprovisionismadeinthewholeactfordeterminingwhetheraparticularindividualslavedoesordoesnotfallwithintheclassesdefinedinthatsection。Heistobefreeuponcertainconditionsbutwhetherthoseconditionsdoordonotpertaintohimnomodeofascertainingisprovided。Thiscouldbeeasilysupplied。
TothetenthsectionImakenoobjection。Theoaththereinrequiredseemstobeproper,andtheremainderofthesectionissubstantiallyidenticalwithalawalreadyexisting。
Theeleventhsectionsimplyassumestoconferdiscretionarypowerupontheexecutive。Withoutthelaw,IhavenohesitationtogoasfarinthedirectionindicatedasImayatanytimedeemexpedient。
AndIamreadytosaynow——Ithinkitisproperforourmilitarycommanderstoemploy,aslaborers,asmanypersonsofAfricandescentascanbeusedtoadvantage。
Thetwelfthandthirteenthsectionsaresomethingbetterthanunobjectionable;andthefourteenthisentirelyproper,ifallotherpartsoftheactshallstand。
ThattowhichIchieflyobjectpervadesmostpartsoftheact,butmoredistinctlyappearsinthefirst,second,seventh,andeighthsections。Itisthesumofthoseprovisionswhichresultsinthedivestingoftitleforever。
Forthecausesoftreasonandingredientsoftreason,notamountingtothefullcrime,itdeclaresforfeitureextendingbeyondthelivesoftheguiltyparties;whereastheConstitutionoftheUnitedStatesdeclaresthat\"noattainderoftreasonshallworkcorruptionofbloodorforfeitureexceptduringthelifeofthepersonattainted。\"True,thereistobenoformalattainderinthiscase;still,Ithinkthegreaterpunishmentcannotbeconstitutionallyinflicted,inadifferentform,forthesameoffence。
WithgreatrespectIamconstrainedtosayIthinkthisfeatureoftheactisunconstitutional。Itwouldnotbedifficulttomodifyit。
ImayremarkthattheprovisionoftheConstitution,putinlanguageborrowedfromGreatBritain,appliesonlyinthiscountry,asI
understand,torealorlandedestate。
Again,thisactinremforfeitspropertyfortheingredientsoftreasonwithoutaconvictionofthesupposedcriminal,orapersonalhearinggivenhiminanyproceeding。Thatwemaynottouchpropertylyingwithinourreach,becausewecannotgivepersonalnoticetoanownerwhoisabsentendeavoringtodestroythegovernment,iscertainlynotsatisfactory。Still,theownermaynotbethusengaged;andIthinkareasonabletimeshouldbeprovidedforsuchpartiestoappearandhavepersonalhearings。Similarprovisionsarenotuncommoninconnectionwithproceedingsinrem。

ThefollowingorderhasbeenreceivedfromthePresidentoftheUnitedStates:
RepresentationshavebeenmadetothePresidentbytheministersofvariousforeignpowersinamitywiththeUnitedStatesthatsubjectsofsuchpowershaveduringthepresentinsurrectionbeenobligedorrequiredbymilitaryauthoritiestotakeanoathofgeneralorqualifiedallegiancetothisgovernment。ItisthedutyofallaliensresidingintheUnitedStatestosubmittoandobeythelawsandrespecttheauthorityofthegovernment。Foranyproceedingorconductinconsistentwiththisobligationandsubversiveofthatauthoritytheymayrightfullybesubjectedtomilitaryrestraintswhenthismaybenecessary。
