  IhavedigressedMr.Schererunfoldedhisscheme,talkingabout\"units\"ascalmlyasthoughtheywerecheckersonaboardinsteadofhuge,fiery,reverberatingmillswherethousandsandthousandsofhumanbeingstoileddayandnight——beingswithfamilies,andhopesandfears,whosedestiniesweretobedominatedbythewillofthemanwhosatoppositeme.But——didnotheinhisownpersonrepresentthetriumphofthatAmericancreedofopportunity?He,too,hadbeenthroughthefire,hadsweatedbesidetheblasts,hadhandledtheingotsofsteel.Hewasoneofthe\"fittest\"whohadsurvived,andlookedit.Hadhenomemoriesoftheterrorsofthatstruggle?AdolfSchererhadgrowntobeagiant.Andyetwithoutme,withoutmyprofessionhewasahelplessgiant,atthemercyofthosealertandvindictivelawmakerswhosoughttorestrainandhamperhim,tocheckhisgrowthwiththeirwebs.Howstimulatingtheideaofhisdependence!Howexhilaratingtoo,thethoughtthatthatvisionwhichhadfirstpossessedmeasanundergraduate——onmyvisittoJerryKyme——wasatlasttoberealized!I

  WhenIreturnedtotheofficeIwroteTheodoreWatlingaletterexpressingmygratitudeforthepositionhehad,sotospeak,willedme,ofconfidentiallegaladvisertoAdolfScherer.Thoughtheopportunityhadthrustitselfuponmesuddenly,andsoonerthanIexpectedit,Iwasdeterminedtoprovemyselfworthyofit.IworkedasIhadneverworkedbefore,makingtripstoNewYorktoconsultleadingmembersofthisnewbranchofmyprofessionthere,tripstoWashingtontoseemyformerchief.Therewere,too,numerousconferenceswithlocalpersonages,withMr.DickinsonandMr.Grierson,andJudahB.Tallant,——whosenewspaperwasmostuseful;therewereconsultationsandnegotiationsofadelicatenaturewiththeownersandlawyersofothercompaniestobe\"takenin.\"

  Norwasitalllegalwork,intheolderandnarrowersense.Menwhoareplayingforprincipalitiesaremakingwar.Someofouroperationshadalltheexcitementofwar.Therewasinformationtobegot,anditwasgot——somehow.Modernwarinvolvesaspysystem,andafriendlytelephonecompanyisnottobedespised.Andallofthisworkfromfirsttolasthadtobedonewithextremecaution.Moribunddistinctionsofrightandwrongdidnottroubleme,forthemodernmanlaboursreligiouslywhenheknowsthatEvolutionisonhisside.

  Foralloftheseoperationsacorpsofcounselhadbeenemployed,includingthefirmofHarringtonandBowesnexttoTheodoreWatling,JoelHarringtonwasdeemedtheablestlawyerinthecity.WeorganizedinduetimethecorporationknownastheBoyneIronWorks,Limited;atrustagreementwasdrawnupthatwasamasterpieceofitskind,onethatcaused,firstandlast,meddlingofficialsintheDepartmentofJusticeatWashingtonnolittletroubleandperplexity.IwasproudofthefactthatIhadtakennosmallpartinitscompositionInshort,inadditiontocertainemolumentsandopportunitiesforinvestment,I

  AyearorsoaftertheBoyneCompany,Ltd.,cameintoexistenceIchancedonemorningtogodowntothenewAshuelaHoteltomeetaNewYorkerofsomeprominence,andwasawaitinghiminthelobby,whenIoverheardaconversationbetweentwocommercialtravellerswhoweresittingwiththeirbackstome.

  Ourfathersappearedstaidatsixandthirty.Clothes,ofcourse,madesomedifference,andmyclassandgenerationdidnotwearthesombreandcumbersomekind,withskirtsandtails;IpatronizedatailorinNewYork.Mychestnuthair,alittledarkerthanmyfather\'shadbeen,showednosignsofturninggrey,althoughitwasthinningalittleatthecrownoftheforehead,andIworeasmallmoustache,clippedinastraightlineabovethemouth.Thismademelooklesslikeacollegeyouth.Thankstoastrongpigmentinmyskin,derivedprobablyfromScotch-Irishancestors,mycolourwasfresh.Ihavespokenofmylifeasfeverish,andyetIamnotsosurethatthiswordcompletelydescribesit.Itwasfulltooverflowing——onesideofit;andIdidnotmisssavevaguely,inraremomentsofwearinessanyothersidethatmighthavebeendeveloped.Iwasbusyalldaylong,engagedinaffairsIdeemedtobealoneofvitalimportanceintheuniverse.IwasconvincedthatthewelfareofthecitydemandedthatsupremefinancialpowershouldremaininthehandsofthegroupofmenwithwhomIwasassociated,andwhosebattlesIfoughtinthecourts,inthelegislature,inthecitycouncil,andsometimesinWashington,——althoughtheywerewellcaredforthere.

  Byeverymeansingenuitycoulddevise,theirenemiesweretobedrivenfromthefield,andtheyweretobeprotectedfromblackmail.

  Asenseofimportancesustainedme;andIrememberinthatfirstflushofasuccessforwhichIhadnotwaitedtoolong——whatasecretsatisfactionitwastopickuptheEraandseemynameembeddedincertaindignifiednoticesofboardmeetings,transactionsofweight,orcasesknowntotheinitiatedassignificant.\"Mr.Scherer\'sinterestsweretakencareofbyMr.HughParet.\"Thefactthatmytriumphsweremodestlysetforthgavememorepleasurethaniftheyhadbeentrumpetedinheadlines.AlthoughImighthavestartedoutinpracticeformyself,myaffectionandregardforMr.Watlingkeptmeinthefirm,whichbecameWatling,FowndesandParet,andanew,arrangementwasenteredinto:Mr.Riponretiredonaccountofillhealth.

  Therewereinstances,however,whenacertainamountofannoyingpublicitywasinevitable.SuchwasthefamousGalligancase,whichoccurredsomethreeorfouryearsaftermymarriage.AloysiusGalliganwasabrakeman,andhislegshadbecomeparalyzedastheresultofanaccidentthatwastheresultofdefectivesillsonafreightcar.Hehadsued,andbeenawardeddamagesof$15,000.TotheamazementandindignationofMillerGorse,theSupremeCourt,towhichtheRailroadhadappealed,affirmedthedecision.Itwasn\'tthesinglepaymentof$15,000

  thattheRailroadcaredabout,ofcourse;aprecedentmightbeestablishedforcompensatingmaimedemployeeswhichwouldbeexpensiveinthelongrun.Carelessnesscouldnotbeprovedinthisinstance.Gorsesentforme.IhadbeenawaywithMaudeattheseafortwomonths,andhadnotfollowedthecase.

  OfallmenofmyacquaintanceIhadthoughttheJudgethelasttogrowmaudlinoverthemisfortunesofthosewhowereweakorunfortunateenoughtobedefeatedandcrushedinthestruggleforexistence,anditwasnotwithoutfoodforreflectionthatIdepartedfromhispresence.TomakeMr.Bering\"feelbad\"wasnosmallachievement,andKrebshadbeenresponsibleforit,ofcourse,——notGalligan.Krebshadturneduponcemore!Itseemedasthoughheweredestinedtohauntme.Well,Imadeupmymindthatheshouldnotdisturbmeagain,atanyrate:I,atleast,hadlearnedtoeliminatesentimentalityfrombusiness,anditwasnotwithoutdeprecationIrememberedmyexperiencewithhimattheCapital,whenhehadmademetemporarilyashamedofmyconnectionwithBill709.

  Ihadgotoverthat.AndwhenIenteredthecourtroomthetribunalhavinggraciouslygrantedarehearingonthegroundthatithadcommittedanerrorinthelaw!myfeelingswereoflivelycuriosityandzest.I

  hadnodispositiontounderratehisabilities,butIwasfortifiedbytheconsciousnessofaseriesoftriumphsbehindme,byasenseofassociationwithprevailingforcesagainstwhichhewashelpless.I

  couldaffordtotakeasuperiorattitudeinregardtoonewhowasdestinedalwaystobedramatic.

  AsthecaseproceededIwasratherdisappointedonthewholethathewasnotdramatic——notevenasdramaticashehadbeenwhenhedefiedthepowersintheLegislature.Hehadchangedbutlittle,hestillworeill-

  fittingclothes,butIwasforcedtoacknowledgethatheseemedtohavegainedinself-control,inpresence.Hehadnoddedatmebeforethecasewascalled,ashesatbesidehismaimedclient;andIhadbeenonthealertforahintofreproachinhisglance:therewasnone.Ismiledbackathim

  Hedidnotrant.Heseemedtohaveratheraremarkableknowledgeofthelaw.Inaconversationaltonehedescribedthesufferingsofthemanintheflannelshirtbesidehim,buttherecouldbenoquestionofthefactthathedidproduceaneffect.Thespectatorswereplainlymoved,anditwasundeniablethatsomeofthejudgesworeratherasheepishlookastheytoyedwiththeirwatchchainsormovedthestationeryinfrontofthem.Theyhadseenmaimedmenbefore,theyhadheardimpassioned,sentimentallawyerstalkaboutwivesandfamiliesandGodandjustice.

  Krebsdidnoneofthis.Justhowhemanagedtobringthethinghometothosejudges,tomakethemashamedoftheirrole,justhowhemanaged——inspiteofmyfortifiedattitudetorevivesomethingofthatsenseofdiscomfortIhadexperiencedattheStateHouseisdifficulttosay.Itwasbecause,Ithink,hecontrivedthroughtheintensityofhisownsympathytoenterintothebodyofthemanwhosecausehepleaded,tofeelthedespairinGalligan\'ssoul——animpressionthatwascuriouslyconveyeddespitethedignifiedlimitstowhichheconfinedhisspeech.

  ItwasstrangethatIbegantoberathersorryforhim,thatIfeltacertainreluctantregretthatheshouldthussquanderhispowersagainstoverwhelmingodds.Whatwastheuseofitall!

  Attheendhisvoicebecamemorevibrant——thoughhedidnotraiseit——ashecondemnedtheRailroadforitsindifferencetohumanlife,foritscontentionthatmenwerecheaperthanrolling-stock.

  Iencounteredhimafterwardinthecorridor.Ihadmadeapointofseekinghimout,perhapsfromsomevaguedeterminationtoprovethatourlastmeetinginthelittlerestaurantattheCapitalhadleftnotracesofembarrassmentinme:Iwas,infact,ratheraggressivelyanxioustorevealmyselftohimasonewhohasthrivenontheviewshecondemned,asoneinwhoseunityofmindthereisnorift.Hewasalone,apparentlywaitingforsomeone,leaningagainstasteamradiatorinoneofhisawkward,angularposes,lookingoutofthecourt-housewindow.

  ThePilotpublishedaseriesofsensationalarticlesandeditorialsabouttheGalliganmatter,apictureofGalligan,anaccountofthedestitutestateofhiswifeandfamily.Thetimehadnotyetarrivedwhensuchnewspapersdaredtoattacktheprobityofourcourts,butasystemoflawthatpermittedsuchpalpableinjusticebecauseoftechnicalitieswasbitterlydenounced.Whatchancehadapoormanagainstsuchamolochastherailroad,evenwithalawyerofsuchabilityashadbeenexhibitedbyHermannKrebs?Krebswaspraised,andtheattentionofMr.Lawler\'sreaderswascalledtothefactthatKrebswasthemanwho,someyearsbefore,hadopposedsingle-handedinthelegislaturethenotoriousBillNo.709.Itwaswellknownincertaincircles——theeditorialwentontosay——thatthislegislationhadbeendrawnbyTheodoreWatlingintheinterestsoftheBoyneIronWorks,etc.,etc.HughParethadlearnedatthefeetofanablemaster.Thisfirstsightofmynamethusopprobriouslyflungtothemultitudegavemeanunpleasantshock.IhadseenMr.Schererattacked,Mr.Gorseattacked,andMr.Watling:Ihadallalongrealized,vaguely,thatmyturnwouldcome,andIthoughtmyselftohaveacquiredacompensatingphilosophy.Ithrewthesheetintothewastebasket,presentlypickeditoutagainandrereadthesentencecontainingmyname.Well,therewerecertainpenaltiesthateverycareermustpay.Ihadbecome,atlast,amarkedman,andIrecognizedthefactthatthisassaultwouldbetheforerunnerofmany.

  ItriedtoderivesomecomfortandamusementfromthethoughtofcertainoperationsofminethatMr.Lawlerhadnotdiscovered,thatwouldhavebeenmattersofpeculiarinteresttohisinnocentpublic:certainextra-

  legaloperationsatthetimewhentheBovinecorporationwasbeingformed,forinstance.AndhowtheywouldhavelickedtheirchopshadtheylearnedofthatmanoeuvrebywhichIhadmanagedtohaveoneofMr.

  Scherer\'ssubsidiarycompaniesinanotherstate,withpropertyandassetsamountingtomorethantwentymillions,reorganizedunderthelawsofNewJersey,andthependingcasethustransferredtotheFederalcourt,wherewewonhandsdown!ThisGalliganaffairwasnothingtothat.

  Nevertheless,itwasannoying.AsIsatinthestreetcaronmywayhomeward,amanbesidemewasreadingthePilot.Ihadaqueersensationasheturnedthepage,andscannedtheeditorial;andIcouldnothelpwonderingwhatheandthethousandslikehimthoughtofme;whathewouldsayifIintroducedmyselfandaskedhisopinion.Perhapshedidnotthinkatall:undoubtedlyhe,andthepublicatlarge,wereusedtoMr.

  Lawler\'sdailydisplayof\"injustices.\"Nevertheless,likeslowacid,theymustbeeatingintothepublicconsciousness.Itwasanoutrage——

  thisfreedomofthepress.

  WithrenewedexasperationIthoughtofKrebs,ofhisdisturbingandalmostuncannyfacultyoffollowingmeup.Whycouldn\'thehaveremainedinElkington?Whydidhehavetofollowmehere,tomakecapitaloutofacasethatmightneverhavebeenheardofexceptforhim?IwasstillinthisdisagreeableframeofmindwhenIturnedthecornerbymyhouseandcaughtsightofMaude,inthefrontyard,bendingbareheadedoverabedoflateflowerswhichthefrosthadspared.Theeveningwassharp,theduskalreadygathering.
